Our Regulatory Arrangements

Our new outcomes-focused regulatory approach went live on 6 October 2011. The new approach is risk-based, concentrated less upon compliance with prescriptive rules and more explicitly focused upon the delivery of specific positive outcomes for clients.

The new regulatory regime is underpinned by the Handbook which sets out the regulatory responsibilities of all individuals and firms regulated by us. The previous Rules and Guidance Notes have been replaced with Codes which, wherever possible, are comprised of flexible, higher-level principles rather than detailed prescriptive requirements. Non-mandatory Guidance accompanies many of the Codes. The seven Frameworks set out our operating parameters.

The Client Charter identifies the Outcomes which clients of our regulated community have the right to expect and the options available to them if their expectations are not met.

Notes: A small number of amendments have been made to the CLC Handbook and CLC Frameworks documents since initial publication. The changes can be summarised as follows:

  1. On page 6 of the Handbook, a date and citation have been added;
  2. On page 6 of the Handbook, notification has been added that the CLC can still take action in respect of any breach of the CLC Rules and Guidance Notes which occured before 6 October 2011;
  3. On page 22 of the Handbook, guidance accompanying item 12.8 now references Approved Person.
  4. On page 25 of the Handbook, typing error at item 13.6 corrected.
  5. On page 32 of the Handbook, item references at 18.2.6 amended.
  6. On page 50 of the Handbook, the postal address for the Legal Ombudsman has been updated.
  7. On page 76 of the Handbook, the Equality Code Guidance now makes reference to new Common Best Practice Code for Quality Internships;
  8. On page 87 of the Handbook, a footnote has been added to the Notification Code signposting to the 10% provision of the Recognised Body Framework;
  9. On page 171 of the Handbook, the Company definition has been amended; and
  10. In the Frameworks document several introductions to individual Frameworks are more explicit in their reference to the Outcomes and Overriding Principles.
  11. On page 102 of the Handbook, hyperlink to the FSA register, rather than the FSA homepage
